This warranty is limited and restricted to the processes of supply and install of internal plastering and painting materials specified in the sub-contract signed by and between BSCI and QDVC (Q.S.C.) in relation to the Dahlak Island Resort Project “Phase 2”, State of Eretria.
LIMITED WARRANTY.
BSCI warrants the products of internal plastering and painting used to execute the Dahlak Island Resort Project “Phase 2”, State of Eretria, are manufactured by TERRACO® Company and supplied & installed by BSCI. It’s also to warrant the executed works meet the requirements and are in conformity with regulations of TERRACO® approved system as well as the international standards of workmanship. All the sub-contract works will be performed in a commercially reasonable manner and will be performed to industry standards or better. As well, BSCI shall be responsible for all internal plastering and painting installation means, methods and sequences. . The materials installed by BSCI are the materials specified in the sub-contract signed by and between BSCI and QDVC (Q.S.C.) in relation to the Dahlak Island Resort Project “Phase 2”, State of Eretria, taking into consideration that BSCI is not responsible for the suitability of painting colours and design specified by QDVC (Q.S.C.) or by the customer.
BSCI warrants that all labor and materials will be paid for, and there will be no potential lien claimants upon the completion of the work and final payment by QDVC (Q.S.C.) or by the customer.
This limited warranty covers any TERRACO® internal plastering and painting materials installation process sold by BSCI to Dahlak Island Resort Project “Phase 2”, State of Eretria, to be free from installation defects in workmanship. In that manner BSCI shall, with all due care and diligence, execute and complete the sub-contract works and remedy any defects that may arise during installation process in accordance with applicable laws and international workmanship standards. BSCI shall provide all superintendence, labor, materials and equipment required in and for such remedying for any installation defects that may arise during installation process. As an environmental criterion, BSCI will not utilize any finishing materials known to its knowledge to be directly toxic or harmful to persons or the environment.
THIS WARRANTY IS GINEN IN LIEU OF ANY EXPRESS OR IMPLIED WARRANTY OTHERWISE PROVIDED UNDER THE LAWS OF QATAR, INCLUDING THE WARRANTY OF FITNESS OR MERCHANTIBILITY.
WARRANTY LMITATION.
BSCI is not responsible for the safeness or function of design(s) furnished by QDVC (Q.S.C.) or by the customer. As such, BSCI is not responsible for property damage or the consequences thereof.
This warranty does not extend to:
• Any installed processes or materials that have been damaged or rendered defective as a result of use or other misuse, abuse or negligence.
• Improper transportation by QDVC(Q.S.C.) , by the costumer or by any third party.
• Any defects caused by external force, abuse or improper installation of third party.
• Cosmetic damages such as scratches or discoloured as a result to scratching or using of any chemical component or any other material that could harm or effect the installed materials.
DISCLAIMER OF WARRANTY.
Except for the express warranty provided and to the extent permitted by applicable law, BSCI, does not issue any warranty or guarantee for the supplied materials or the installation process. BSCI expressly excludes any other liability, whether express or implied, to the fullest extent allowed by the law. In particular, but without limit to the generality of the exclusion, any implied terms as to merchantability, satisfactory quality, fitness for a particular purpose and / or non- infringement of third party rights are excluded whether in contract or tort. Any implied warranties that may be imposed by law are limited in duration to the term of the express limited warranty given by BSCI to the extent permitted by applicable law.
To the maximum extent permitted by applicable law, in no event shall BSCI be liable for (1) damages to, or loss or corruption of installed materials or installation process, or (2) any damages whatsoever (including direct or indirect damages, loss of business profits, lost savings or other special, incidental, exemplary or consequential damages whether for breach of warranty, contract, strict liability, tort or otherwise) arising out of or resulting from the use of QDVC (Q.S.C.) or the customer. In any event, any liability of BSCI which is not excluded shall be limited to the purchase price of the supplied materials and installation process.
Note: without prejudice to any provision of the sub-contract signed by and between BSCI and QDVC (Q.S.C.) in relation to the Dahlak Island Resort Project “Phase 2”, State of Eretria, BSCI reserves the right to alter or cancel this agreement at any time without prior notice.

هذا الضمان محدود ومقتصر على عملية توريد وتركيب مواد الدهانات والمحارة الداخلية المنصوص عليها فى العقد من الباطن الموقع بين كل من شركة بن شبعان للصناعات الكيماوية BSCI وشركة QDVC (Q.S.C.) فيما يتعلق بمشروع منتجع جزيرة دهلك بدولة اريتريا "المرحلة الثانية".
الضمان المحدود.
تضمن شركة BSCI أن منتجات المحارة والدهانات الداخلية المستخدمة فى تنفيذ بمشروع منتجع جزيرة دهلك بدولة اريتريا "المرحلة الثانية" هى مواد مصنعة من قبل شركة TERRACO وتم توريدها زتركيبها بواسطة شركة BSCI. كما تضمن أن الأعمال المنفذة تطابق متطلبات وقواعد نظام TERRACO المتفق على تنفيذة كما تطابق المعايير الدولية للصنعة. وكذلك تضمن تنفيذ الأعمال المتعاقد على تنفيذها فى العقد من الباطن بطريقة تجارية معتدلة كما سيتم تنفيذها حيب معايير الصنعة المتفق عليها أو أفضل.

تم منح هذا الضمان عوضا عن أى ضمان صريح أو ضمنى بخلاف ما يندرج تحت قانون دولة قطر، بما فى ذلك ضمان الملائمة أو الضمان التجارى.
حدود الضمان.

• الاضرار الظاهرية مثل الخدوش أو تغير اللون الناجمة عن الخدوش أو الناجمة عن استخدام اية مكونات كيميائية أو أيه مواد أخرى من شأنها إلحاق الضرر أو إلحاق تأثير على المواد التى تم تنفيذها.
إخلاء المسئولية عن الضمان.
إن BSCI لا تصدر أى ضمان أو كفالة عن المواد الموردة أو أعمال التركيب والتنفيذ بخلاف الضمان الصريح الذى تمنحه BSCI والمدى الذى تسمح به القوانين قابلة النفاذ. كما أن BSCI تستبعد صراحة أى مسئولية أخرى سواء كانت صريحة أو ضمنية، وذلك باتساع ما يسمح به القانون. على وجه التحديد وبلا تقييد تعميم الاستبعاد فإنه قد تم استبعاد اى شروط ضمنية مثل الشروط التجارية وشروط رضاء الجودة وشروط الملائمة للأغراض الخاصة و/ أو بلا انتهاك حقوق اى طرف ثالث. تكون اى ضمانات ضمنية قد يفرضها القانون محدودة المدة فيما يخص الضمان الصريح المحدود الذى تمنحة BSCI وبمدى ما يسمح به القانون القابل النفاذ.
بأقصى اتساع ما يسمح به القانون فإن BSCI لن تكون مسئولة عن (1) أى اضرار أو خسارة أو فساد المواد المنفذة أو اعمال التركيب، و (2) اى اضرار أى كانت طبيعتها (بما فى ذلك الاضرار المباشرة والغير مباشرة أو خسارة الأرباح التجارية أو خسارة المدخرات أو اى اضرار خاصة أو عرضية أو تحذيرية أو ما ينجم عن ذلك من أضرار سواء كانت عن ثغرة فى اى من العقد أو الضمان أو المسئولية المباشرة) تكون ناجمة عن أو تكون نتيجة لاستخدام شركة QDVC (Q.S.C.) أو استخدام العميل. بأى شكل كان فأن اى مسئولية على عاتق BSCI لم يتم استبعدها من هذا الضمان ستكون محددة بسعر شراء المواد الموردة والأعمال المتفق على تنفيذها.

English to Arabic: Changing Minds - Winning Peace a new strategic direction for u.s. public diplomacy in the Arab & muslim world
Source text - English in the aftermath of the cold war and the terrorist attacks of September 11, 2001, the United States of America is engaged in a major struggle to expand the zone of tolerance and marginalize extremists, whether secular or religious, especially in the Arab and Muslim world.
While the conduct of policy is the primary determinant of success or failure in this struggle, the role of public diplomacy has taken on critical importance in the effort to understand, inform, engage, and influence peo- ple in this important region of the world, home to some 1.5 billion Muslims.
While we refer here to the “Arab and Muslim world,” we recognize that Muslim societies and countries are diverse — culturally, linguistical- ly, ethnically, and even religiously — and that, as in other regions of the world, we have to tailor our approach accordingly.
While our mandate is focused on the Arab and Muslim world, the analysis and recommendations that we present in this report necessarily go to the larger challenges of U.S. public diplomacy.
To meet this public diplomacy challenge, several important studies have been issued recently, including:
» “The Report of the Defense Science Board Task Force on Managed
Information Dissemination” (2001), by the Office of the Under
Secretary of Defense for Acquisition, Technology and Logistics;
» “Building America’s Public Diplomacy Through a Reformed Structure and Additional Resources” (2002), a report of the U.S. Advisory Commission on Public Diplomacy;
» “Finding America’s Voice: A Strategy for Reinvigorating U.S. Public
Diplomacy” (2003), the report of an independent task force sponsored by the Council on Foreign Relations;
» “U.S. Public Diplomacy” (2003), by the U.S. General Accounting Office;
» “Strengthening U.S.-Muslim Communications” (2003), from the
Center for the Study of the Presidency;
» “How to Reinvigorate U.S. Public Diplomacy” (2003), by Stephen
Johnson and Helle Dale, published by the Heritage Foundation; and
» “The Youth Factor: The New Demographics of the Middle East and the Implications for U.S. Policy” (2003), a Brookings Institution study by Graham E. Fuller.
Congress, too, became concernedabout how to meet this public diplo- macy challenge, and in June 2003 the House Appropriations Committee, whose subcommittee of jurisdiction is chaired by Rep. Frank Wolf, included a directive in the supplemental appropriations bill that stated:
“The Committee expects the Department to engage the creative tal- ents of the private sector to the maximum extent possible to develop new public diplomacy approaches and initiatives. In this regard, the Committee expects the Department [of State] to establish an advisory group on public diplomacy for the Arab and Muslim world to recommend new approaches, initiatives and program models to improve public diplo- macy results. This advisory group should include individuals with exten- sive expertise in public diplomacy, media, public relations, and the region….”
I was asked by Secretary of State Colin Powell to chair this advisory group, which has 13 members and which began meeting in early July and continued its work through the end of September. We contacted and were briefed by dozens of specialists and practitioners, both here and abroad in the public and private sectors, including non-governmental organiza- tions. We traveled to Egypt, Syria, Turkey, Senegal, Morocco, the United Kingdom, and France. We used video conferencing for discussions with individuals in Pakistan and Indonesia.
I wish to commend the outstanding competence and work of this advisory group, whose members gave voluntarily of their time to tackle this difficult issue intensively over a short period of three months.
The earlier reports, cited above, were very useful to our work. We thank their authors, as well as the many individuals who spent time sharing their views and insights with us.
I wish also to thank Secretary Powell, Deputy Secretary Richard
Armitage, and Assistant Secretary Patricia Harrison for all the support
that they extended to the Advisory Group to accomplish its mission. We especially appreciate the dedication of the U.S. Government personnel, both in Washington and in the field, and of the foreign service nationals in the embassies and the consulates that we visited.
Given the statutory responsibilities of the U.S. Advisory Commission on Public Diplomacy to follow up and evaluate public diplomacy programs, its members may wish to pursue this function relative to the findings of this report.
We hope this report will bring about the changes needed to provide strategic direction and help secure the resources to accomplish the crucial work of public diplomacy.

انخرطت الولايات المتحدة الأمريكية فى أعقاب الحرب الباردة وهجمات 11 سبتمبر 2001 الإرهابية فى صراع كبير لتوسيع نطاق التسامح و تهميش المتطرفين - سواء الدينين منهم أو العلمانين - خاصة فى العالمين العربى والإسلامى.
فى حين أن السلوك السياسى هو العامل الاساسى فى نجاح أو فشل هذا الصراع، فإن دور الدبلوماسية العامة هو أن تتحمل على عاتقها الأهمية القصوى فى عناء توصيل الفهم وإعلام وجذب والتأثير فى شعوب هذه المنطقة الهامة من العالم، موطن 1.5 مليار مسلم.
وبينما نشير هنا إلى "العالم العربى والإسلامى" فإننا ندرك أن المجتمعات والدول الإسلامية متنوعة - ثقافياً ولغوياً وعرقيا وحتى دينياً - ولهذا فإنه يتحتم علينا أن نكييف مسارنا طبقا لذلك - كما هو الحال فى مناطق أخرى من العالم.
ومع أن التفويض الممنوح لنا يتمحور حول العالم العربى والإسلامى فإن التحليل والتوصيات التى نقدمها فى هذا التقرير تذهب بالضرورة إلى أكبر التحديات التى تواجهها الدبلوماسية العامة الأمريكية.
ولمواجهة هذا التحدى للدبلوماسية العامة كان لابد من إصدار عدة دراسات هامة مؤخراً تتضمن:

وقد أصبح الكونجرس أيضاً مهتماً بكيفية مواجهة الدبلوماسية العامة لهذا التحدى، وفى يونيو من عام 2003 قامت لجنة الإعتمادات بمجلس النواب - التى يترأس لجنتها الفرعية القضائية النائب فرانك وولف - بإدراج توجيهات مشروع قانون الإعتمادات الإضافية التى نصت على:
" تتطلع اللجنة أن تقوم وزارة الخارجية بإشراك الموهوبين المبدعين من القطاع الخاص إلى أقصى مدى يمكن استيعابه لتنمية التوجيهات والمبادرات الجديدة للدبلوماسية العامة، وفى هذا السياق فإن اللجنة تتوقع أن تنشئ وزارة الخارجية مجموعة استشارية للدبلوماسية العامة للعالم العربى والإسلامى لكى توصى بالتوجيهات والمبادرات والخطط النموذجية الجديدة لتحسين نتائج الدبلوماسية العامة. ويتوجب على هذه المجموعة الإستشارية أن تشمل أفراد ذوى خبرة واسعة فى الدبلوماسية العامة والإعلام والعلاقات العامة و...."
كان السيد/ كولن باول وزير الخارجية قد طلب منى ترأس هذه المجموعة الإستشارية، التى تتضمن 13 عضواً والتى بدأت اجتماعاتها فى أوائل شهر يوليو واستمرت فى أعمالها حتى أخر شهر سبتمبر. وقد قمنا بالإتصال وبالاجتماع مع العشرات من المتخصصين والممارسين هنا فى الداخل وفى الخارج وفى القطاعين العام والخاص بما فى ذلك المنظمات غير حكومية، كما سافرنا إلى مصر وسويا وتركيا والسنغال والمغرب والمملكة المتحدة وفرنسا، واستخدمنا مؤتمرات الفيديو (الفيديو كونفرانس) لإجراء نقاشات مع شخصيات فى باكستان وإندونيسيا.
وأرغب فى الإشادة بالعمل الجدير والرائع الذى قامت به هذه المجموعة الاستشارية، التى بذل أعضاؤها من وقتهم طواعيةً ليعكفوا على الدراسة المكثفة لهذا الموضوع الصعب فى مدة زمنية قصيرة خلال ثلاثة أشهر.
