Dutch term

Opstal

Dutch to English Law/Patents Law: Contract(s) real estate
Hello,

Can anyone help me with term 'opstalrecht - opstalgever - opstalhouder' in a contract?
I found 'right of superficies' and used 'provider and holder of superficies' for opstalgever and opstalhouder but it doesn't get many hits.

Any other suggestions would be greatly appreciated...

Cheers,

Jonathan

In addition to writeaway's comments, could I also just point out that Kudoz rules stipulate you wait for at least 24 hrs before grading, not least because it allows others (in different time zones) to submit other possible solutions and/or vote
writeaway Nov 20, 2006:
may be helpful if you post the whole sentence in NL.
writeaway Nov 20, 2006:
those are 3 terms-you should post each one separately.
2.3 One term is allowed per question. Including multiple terms for translation in a single KudoZ posting interferes with the process of generating glossary entries. http://www.proz.com/?sp=siterules&mode=show&category=kudoz_a...

recht van opstal = building and planting rights, soms ook building lease. Hangt af van de context. Een search op yahoo levert allerlei sites met meer info op

Building / structures & Owner / Superficiary

Ownership of land with property on it is divided, so that the land itself remains the property of the land owner / proprietor (opstalgever), and structure / buildings on the land become the property of the superficiary (opstalhouder).

Opstalrecht is as you say: right of superficies / building (and planting) rights.

A Dutch explanation of the system is provided here:
