APPEAL PROCEDURES
INFORMATION FOR PARENTS
1. REFUSAL OF YOUR CHOICE OF SCHOOL
The letter which you have received from the Director of Children and Families will have told you the reasons for the Council’s decision to refuse a place at the school(s) you wanted your child to go to. If you wish to appeal against this decision, you must make a “reference” to an Appeal Committee which will look at your case independently. The purpose of this leaflet is to tell you how to make your reference, the things you will have to do, and the people you should expect to come across.
2. YOUR APPEAL
A reference should be made in writing to :

The reference should include :
-your name, address and telephone number;
-the name of your child;
-the name of the school concerned;
-the date of the Council’s letter.
If you have not included any of these, the acknowledgement from the Clerk to the Appeal Committee will ask for details.
Your letter does not have to have said why the Council refused your request, because this information will be given to the Appeal Committee. You may, of course, add to your letter later in writing or say more about the case at the Appeal Committee hearing.
Please remember that you can only appeal once a year.
3. ARRANGING THE HEARING
The Council Secretary has been asked to act as the Clerk to the Appeal Committee in Edinburgh. He will acknowledge receipt of your reference within 5 working days.
The likely date for your case to be heard will be approximately one month after receipt of your original appeal letter, if your case is the only one for a particular school.
However, if your case is one of a number for a particular school, the likely date for your case to be heard will be approximately six weeks after receipt of your original appeal letter.
The Clerk will tell you the date, time and place of the hearing of your appeal as soon as possible after the meeting is arranged.
4. FURTHER INFORMATION
Both you and the Council can ask the Appeal Committee to consider extra information about your case, but if it is in written form, it should be sent to the Clerk at least 10 days before the meeting. Both you and the Council must give each other copies of any additional information.
5. PREPARING FOR THE HEARING
The Clerk will tell you the date, time and place of the hearing of your appeal. Before the hearing takes place, you have to decide how you want to tell the Committee about your reasons for appealing.
The sort of things which you will need to decide upon are noted below; it is not essential that you do any of these things, because even if you do not give written arguments, or you do not attend the hearing or send a representative, the Committee will consider the information given to them by the Council and then reach a decision on your case.
You can go to the hearing and speak to the Appeal Committee yourself.
You can take up to three people with you, and if you do not wish to speak yourself, you can ask one of these people to speak for you.
If you cannot go yourself, you can ask somebody else to go in your place and speak for you.
You can put your arguments in writing beforehand. You can do this even if you also want to go and speak, or ask someone else to speak for you.
6. WHO IS ON THE APPEAL COMMITTEE?
In Edinburgh, the Council has established an Appeal Committee comprising three people. The three people are:-
-1 member drawn from the Council or from the Council Executive when considering Education functions;
-1 member drawn from a panel of parents of pupils of school age nominated by the Consultative Committee with Parents;
-1 member, who will be the Chairperson, drawn from a panel of suitably qualified people with experience in education or acquainted with educational conditions in Edinburgh.
None of these people will have had any involvement in the decision to refuse your child a place at the school. Also, no person can be a member of the Appeal Committee if they are a parent or a teacher at the school concerned.
7. WHAT HAPPENS AT THE HEARING?
When the hearing starts, the Chairperson will say how the Committee intends to conduct the proceedings. Normally what will happen will be that:-
The Council’s Case
The person speaking for the Council, normally an officer from Children and Families, will say why your request has been refused.
Other people may be asked to speak, in support of what the Council has decided. Then you, or the person you have asked to speak for you, can ask questions as can the three members of the Appeal Committee.
Your Case
Next, it is your turn to present your case. Either you, or the person speaking for you, can tell the Appeal Committee why you think your child should get a place in the school you want and why you think the Council should not have refused. You can also ask people to speak in support of what you say. But if you have written down your reasons and sent them to the Appeal Committee and the Council beforehand, you can say, if you want, that you have nothing to add to your letter. After that, the person speaking for the Council may ask questions as can the five members of the Appeal Committee.
Summing Up
Finally, the person speaking for the Council will sum up their reasons; and you, or the person speaking for you, may sum up your reasons.
8. ADJOURNMENT OF THE HEARING
It is possible that the hearing of your reference may be adjourned. This would happen in the following circumstances:-
If some of the Appeal Committee members do not turn up, or if an Appeal Committee member has to leave before the end of the hearing, the hearing must be adjourned.
A hearing may be adjourned if either you or the Council say anything to the Committee or produce something in writing, which the other did not know about beforehand, and it is so important that you or the Council want time to think about it before proceeding. Both you and the Council can ask the Committee to adjourn and fix a later date for carrying on with the rest of the proceedings. But the Committee does not have to agree to this if it thinks that the new information is not important.
If the Appeal Committee needs further information or advice, the hearing must be adjourned. For example, it may be that some legal point has arisen and the Council has a duty to provide legal advice if required.
Where the Appeal Committee is satisfied that either you or the Council requires to get further relevant information or advice for the presentation of the case, then it must adjourn the hearing.
If either you or the Council’s representative are prevented by exceptional circumstances from attending the hearing, then the hearing must be adjourned if it is reasonable to do so.
A hearing might also be adjourned in order to be combined with another similar reference dealing with the same school and the same stage of education.
9. WHO ELSE WILL BE AT THE HEARING?
The hearing will be held in private. Apart from the people speaking for you and for the Council, and the Appeal Committee members themselves, only a limited number of other people may be at a hearing. For example, the Clerk to the Committee will be there, an official from the Scottish Council on Tribunals may be there, as might other Councillors who are interested in your case. However, members of the public cannot be there.
10. HOW LONG WILL A DECISION TAKE?
This depends upon whether the Appeal Committee decides that it will have to adjourn the hearing and carry on with it later because some new and important information has been produced, or because the Committee want you or the Council to give it more information. The Committee must give its decision within 14 days of the end of the hearing. It must also give the decision in writing to you and the Council, and the reasons for it. In Edinburgh, the Chairperson will tell you at the end of the summing up of your case what the Committee proposes to do.
If the Committee disagrees with the Council and says that it should not have refused your request, then the Council must let your child have a place in the school you asked for.
11. APPEAL TO THE SHERIFF
Having heard all the evidence, the Committee may still decide to agree that the Council was right to refuse your child a place in the school you wanted. If you feel very strongly that the Council should have given your child a place, you can appeal to the Sheriff against the Appeal Committee’s decision. But you must do this within 4 weeks of receiving the Appeal Committee’s decision from the Clerk.

8. ODROCZENIE POSIEDZENIA
Odroczenie posiedzenia w sprawie Pana/Pani odwołania jest możliwe w następujących okolicznościach:-
Jeśli któryś z członków Komisji Odwoławczej nie stawi się na posiedzenie, lub jeśli członek Komisji Odwoławczej będzie musiał wyjść przed końcem posiedzenia, posiedzenie musi zostać odroczone.
Posiedzenie może zostać odroczone, jeśli albo Pan/Pani albo Rada powie lub na piśmie przedstawi Komisji coś, o czym druga strona nie wiedziała wcześniej i jest to na tyle istotne, że Pan/Pani lub Rada potrzebuje czasu na przemyślenie tego przed kontynuowaniem postępowania. Zarówno Pan/Pani, jak i Rada może poprosić Komisję o odroczenie dalszej części postępowania oraz ustalenie jego późniejszej daty, lecz Komisja nie musi się na to zgodzić, jeśli uważa, że nowa informacje nie jest istotna.

Na przykład będzie tam Sekretarz Komisji, może także być obecny urzędnik ze Szkockiej Rady ds. Trybunałów (ang. Scottish Council on Tribunals), jak również inni radni, którzy są zainteresowani Pana/Pani sprawą. Jednakże nie mogą być tam obecne osoby postronne.
10. JAK DŁUGO ZAJMIE PODEJMOWANIE DECYZJI?
To zależy od tego, czy Komisja Odwoławcza zadecyduje, że musi odroczyć i później kontynuować posiedzenie, ze względu na to, że zostały przedstawione nowe i istotne informacje, lub ze względu na to, że Komisja chce, aby Pan/Pani lub Rada dostarczyli jej więcej informacji. Komisja musi podjąć decyzję w ciągu 14 dni od zakończenia posiedzenia. Musi ona również na piśmie podać Panu/Pani i Radzie swoją decyzję oraz jej uzasadnienie. W Edynburgu Przewodniczący Komisji pod koniec podsumowania posiedzenia dotyczącego Pana/Pani sprawy powie Panu/Pani co Komisja zamierza zrobić.
Jeśli Komisja nie zgodzi się z Radą i stwierdzi, że nie powinna była ona odrzucić Pan/Pani podania, Rada musi zaoferować Pana/Pani dziecku miejsce w szkole, o którą Pan/Pani prosił/a.
11. ODWOŁANIE DO SĘDZIEGO OKRĘGOWEGO
Po wysłuchaniu wszystkich argumentów Komisja może jednak zadecydować, że zgadza się z tym, iż Rada miała słuszność, odrzucając podanie o przyjęcie Pana/Pani dziecka do szkoły, o którą prosiliście. Jeśli jest Pan/Pani bardzo mocno przekonana, co do tego, że Rada powinna zaoferować Pana/Pani dziecku miejsce, może Pan/Pani odwołać się od decyzji Komisji Odwoławczej do Sędziego Okręgowego. Musi to Pan/Pani jednak uczynić w ciągu 4 tygodni od otrzymania od Sekretarza decyzji Komisji Odwoławczej.

Profilomierz osadów typu boomer (Rysunek 11) holowano za statkiem na kablolinie. W trakcie pomiarów profilomierz pracował na częstotliwości od 300 Hz do 2500 Hz (częstotliwość impulsów 2 Hz). Pomiary na tej częstotliwości pozwalają na rozpoznanie warstw z rozdzielczością około 60 cm.
W trakcie pomiarów ruch pionowy płyty wzbudzającej nie był kompensowany. Dane zapisywane były w formacie cyfrowym przy użyciu systemu Coda GeoSurvey DA 2000.
1.2. Osady denne
P1 ¬– Obszar ze zmienną pokrywą piaszczysto-żwirową na powierzchni wychodni starych glin zwałowych. Położony jest w północno-zachodniej część obszaru badań na głębokości od ok. 30 m do ok. 40 m pod poziomem morza. Teren łagodnie obniża się w kierunku północno-zachodnim w stronę Rynny Słupskiej (Rysunek 30). Zbudowany jest głównie z glin. Po powierzchni glin przemieszczają się formy fal piaszczystych o wysokości od kilkunastu do kilkudziesięciu centymetrów i rozstępie do kilkudziesięciu metrów, asymetryczne, w ruchu w kierunku S i SE, zbudowane głównie z piasków miejscami piasków i żwirów. Północna część jednostki o powierzchni w miarę wyrównanej jest łagodnie nachylona w kierunku N i NW. Południowa i południowo-zachodnia część jednostki posiada silnie uwypukloną rzeźbę powstałą w wyniku działania procesów erozyjnych związanych z rozmywaniem tej partii dna. Deniwelacje dochodzą do 3 m i związane są z grzędami, grzbietami i izolowanymi wierzchołkami reliktów rzeźby morenowej. Są to wypreparowane partie glin zwałowych co najmniej dwóch zlodowaceń. Gliny te są silnie zwarte i mocno złuskowane glacitektonicznie. Zagłębienia między grzbietami i garbami są nieregularne o charakterze zarówno izolowanych zagłębień jak i wydłużonych bruzd. Analizy uziarnienia prób czerpakowych wykazują duże zróżnicowanie związane z charakterem budowy tego pola (gliny w grzędach, piaski i/lub żwiry w zagłębieniach).
1.3. Hydrochemia
Próbki wody pobierano rozetą z dwunastoma batometrami. We wszystkich pobranych próbkach oznaczono następujące parametry: odczyn, zasadowość, zawiesinę, substancje biogeniczne (azot amonowy, azotynowy, azotanowy, mineralny, ogólny oraz fosforany i fosfor ogólny), ogólny węgiel organiczny (OWO) jak również określono warunki tlenowe (tlen rozpuszczony, BZT5). W próbkach pobranych w październiku 2012r. oznaczono zawartość substancji szczególnie szkodliwych: WWA, PCB, metali (Pb, Cd, Cr, Cr(VI), As, Ni, Hg), fenoli, cyjanków wolnych i związanych, olejów mineralnych. Ponieważ badany rejon leży w południowej części Bałtyku Centralnego, w znacznym oddaleniu od źródeł zanieczyszczeń, nie spodziewano się istotnej sezonowej zmienności zawartości wymienionych substancji szkodliwych.
1.4. Hydrologia
Otrzymane w ten sposób ciągi danych dla składowych ruchu wody w warstwach o grubości 1 m uśredniane są, biorąc pod uwagę kolejne warstwy o grubości 4 m każda, licząc od powierzchni morza do jego dna. Pozwoliło to z jednej strony na eliminację przypadkowych fluktuacji prędkości ruchu wody, z drugiej zaś uzyskane dane są porównywalne z wynikami obliczeń prognostycznych modelu hydrodynamicznego dla Morza Bałtyckiego – HIROMB. Uzyskane w ten sposób ciągi danych posłużyły do wykreślania róż kierunkowych dla przepływu wody na różnych głębokościach w toni.
1.5. Bentos
Rośliny porastały otoczaki i głazy (podłoże stałe) jedynie w dwóch lokalizacjach (p05 i p20) zlokalizowanych w strefie buforowej południowej części obszaru MFW. W pozostałych dziewięciu lokalizacjach, przytwierdzone były do niewielkich agregacji omułków przemieszczających się wraz z prądami po dnie piaszczystym (Załącznik 1), tzw. rośliny czasowo występujące w rejonie.
1.6. Nawigacja
Przy planowaniu budowy MFW najczęściej stosuje się przedstawiony na potrzeby analizy schemat budowy. Przykładem przy opracowywaniu potencjalnych oddziaływań była MFW TritonKnoll, której założenia operacyjne zamieszczono poniżej.
• Jako główny port zaopatrzeniowy zostanie wykorzystany najbliższy, zapewniający dogodne warunki port zaopatrzeniowy.
• Zakłada się wybudowanie 333 turbin wiatrowych oraz obiektów towarzyszących.
• Turbiny, wieże turbin i elementy łączące będą dostarczane do portu z zewnątrz.
• Do montażu zostaną wykorzystane dwa duże statki konstrukcyjne.
• Budowę wspierać będzie 15 statków pomocniczych pracujących w rejonie MFW przez okres od dwóch do pięciu lat.
• Prawdopodobne jest zwiększenie liczby głównych statków konstrukcyjnych i odpowiednie skrócenie cyklu budowy.
Indykatywna liczba podróży do portu zaopatrzeniowego dla budowy farmy wiatrowej wyniesie 7700. (Tabela 5. ).

Zakłada się, że dla postawienia jednej turbiny wiatrowej, w zależności od typu fundamentu wymagane będzie do sześciu operacji przemieszczenia statku i stabilizacji poprzez osadzenie podpór na dnie morskim.
Przedstawione w Tabela 4 kategorie wypadków morskich można zaszeregować do grup oddziaływania właściwych z uwagi na źródło oddziaływania oraz receptora - obiekt oddziaływania. Metodyczne pogrupowanie właściwych źródeł oddziaływania, receptorów, potencjalnych oddziaływań oraz przykładowych środków minimalizujących oddziaływanie zostało przedstawione w Tabela 7 na końcu niniejszego podrozdziału. Na Rysunku 1 przedstawiono prawdopodobieństwo kontaktu statku z turbiną wiatrową w scenariuszu D.
Oddziaływanie MFW na nawigację związaną z budową morskiej farmy wiatrowej
Podstawowymi kategoriami zdarzeń nawigacyjnych fazie budowy, których źródłem jest nawigacja bezpośrednio związana z budowa MFW, a których receptorami mogą być statki uczestniczące
w budowie MFW, elementy konstrukcyjne MFW, inne statki uprawiające żeglugę i porty zaopatrzeniowe są:
• Kolizje statków biorących udział w budowie MFW.
Na stosunkowo małym obszarze zgromadzona jest duża liczba statków wykonujących bardzo różne zadania. Część tych zadań wymaga niezwykłej precyzji oraz pozbawienia statku zdolności manewrowania. Prawdopodobna jest sytuacja, że rozpoczęta operacja musi być kontynuowana w warunkach pogarszającego się stanu morza i pogarszającej się widoczności. Duża koncentracja uwagi i stres powodują zmęczenie, którego następstwem może być większe prawdopodobieństwo popełnienia błędu ludzkiego. Skutkiem kolizji mogą być urazy, szkody majątkowe oraz zanieczyszczenie środowiska. Ewentualne straty materialne spowodowane koniecznością zmian w harmonogramie budowy nie są elementem oddziaływania MFW. Prawdopodobieństwo zatopienia statku jest niewielkie i w związku
z tym częstotliwość zdarzeń z konsekwencjami w postaci zgonu jest minimalna. Przykładowo, dla ocena ryzyka nawigacyjnego dla Horns Rev 3 Offshore Wind Farm założono zależność liczby zdarzeń od technologii i projektu wykonawczego, np. wielkość turbin wiatrowych, liczba statków, rodzaj fundamentów. Generalnie przewiduje się zwiększone ryzyko kolizji pomiędzy statkami w obszarze MFW i na trasach dojazdowych do rejonu budowy. Dla kolizji statek – statek przewidziano, że duża liczba statków podczas budowy MFW oraz dłuższy czas pobytu w obszarze MFW zwiększają ryzyko kolizji pomiędzy statkami podczas operowania
w rejonie morskiej farmy wiatrowej. Zwiększone ryzyko kolizji jest też spowodowane większą liczbą podróży pomiędzy MFW a portami.

Tłumaczenie pisemne - angielski 1.1. Geophysics
Boomer type sediment profilometer (Image 11) was towed behind a ship on a cable-laid rope. During measurements the profilometer was working at the frequency ranging from 300 Hz to 2500 Hz (impulses frequency 2 Hz). Measurements at this frequency allow to identify layers with the resolution around 60 cm.
During the measurements vertical movement of the excitation plate was not being compensated. The data were recorded in a digital format with the use of the Coda GeoSurvey DA 2000 system.
1.2. Sea-floor sediments
P1 ¬– area with a changeable sand and gravel cover on the surface of the old glacial till outcrop. It is located in the north-west part of the research area at the depth between around 30 and around 40 m below the sea level. The terrain gently slopes down towards the north-west in the direction of Rynna Słupska (Image 30). It mainly consists of tills. On the tills’ surface there are moving landforms of sand waves ranging from a few to a few tens of centimetres and with up to a few tens of metres gaps between them, asymmetrical, moving in the S and SE direction, built mainly of sand, and at places - of sands and gravels. The north part of the unit with the moderately even surface is gently leaning towards the N and NW. The south and south-west part of the unit has a heavily embossed land relief, created as a result of erosion processes related to caving this section of the sea floor. Denivelations reach 3 m and are related to patches, ridges, and isolated peaks of the glacial relief relics. These are dissected sections of glacial tills from at least two glaciations. These tills are greatly compacted and intensely glaciotectonically flaked. Hollows between ridges and humps are irregular with characteristics of both isolated hollows and elongated furrows. Analyses of the grain size distribution of the bucket dredger samples show large variation related to the nature of this field composure (tills in the patches, sand and/or gravel in the hollows).
1.3. Hydrochemistry
Water sample were taken with the use of a rosette sampler with twelve bathometers. In all drawn samples the following parameters were identified: reaction, alkalinity, suspension, biogenic substances (ammonium nitrogen, nitrite nitrogen, nitrate nitrogen, mineral nitrogen, total nitrogen as well as phosphorus and total phosphorus), total organic carbon (TOC); oxygen levels were also determined (dissolved oxygen, BOD 5). In the samples taken in October 2012 the particularly harmful substances content was marked: PAHs, PCBs, metals (Pb, Cd, Cr, Cr(VI), As, Ni, Hg), phenols, free and bound cyanides, mineral oils. Finding significant seasonal variability in the contents of the mentioned harmful substances was not expected, because the studied area is located in the south part of the Central Baltic, in a great distance from the contaminants’ source.
1.4. Hydrology
Obtained in this way series of data for components of water movement in layers which are 1 m thick each, are averaged while taking into account further layers which are each 4 m thick, counting from the surface of the sea towards its floor. On one hand it has allowed to eliminate the coincidental fluctuations of the water movement speed, and on the other hand the obtained data have been comparable with the results of the prognostic calculations of the hydrodynamic model for the Baltic Sea – HIROMB. The series of data obtained in this way were used to draw the compass roses of the water flow on various depths in water.
1.5. Benthos
Boulders and erratics (solid substrate) were overgrown by plants only in two locations (p05 and p20), which are located in the buffer zone of the south part of the OWF [translator’s note: Offshore Wind Farms] area. In the remaining nine localizations they were attached to small aggregations of mussels, moving along the currents on the sand bottom (Attachment 1), so-called plants temporarily present in the area.
1.6. Navigation
While planning the construction of an OWF - the most often used building scheme is the one presented for analysis needs. OWF TritonKnoll - which operational policy has been presented below - was an example used to formulate its potential impact.
• The closest, ensuring suitable conditions supply harbour will be used as the main supply harbour.
• It is assumed that 333 wind turbines and facilities will be constructed.
• The turbines, the turbine towers and connecting components will be outsourced to the harbour.
• Two large construction vessels will be used for the assembly.
• The construction will be supported by 15 auxiliary ships working in the OFW area for the period of between two and five years.
• It is likely that the number of the main construction ships will be increased and the construction cycle will be shortened accordingly.
Indicative number of the journeys to the supply harbour for the wind turbine farm construction will be 7700 (Table 1. ).

It is assumed that - depending on the foundation type - in order to place and stabilise one wind turbine by embedding supports in the sea floor, up to six ship movements operations will be required.
Categories of sea accidents presented in the Table 4 can be classed as impact groups according to the impact source and the receptor – the impact object. Systematic classification of the relevant influence sources, receptors, potential impacts and examples of measures minimising the impact has been presented in the Table 7 at the end of this sub-section. The probability of the contact of a ship with a wind turbine in the scenario D has been presented on the Picture 1.
Impact of the OFW on navigation related to the offshore wind turbine farm construction
The basic categories of navigational events at the construction stage, which are resulting from navigation directly linked to the OFW construction, and which might affect the vessels participating in the OFW construction, the OFW construction components, other shipping vessels, and supply harbours, are the following:
• Collisions of the vessels participating in the OFW construction.
There is a large number of vessels carrying out various tasks gathered on a relatively small area. A part of these tasks requires exceptional precision and curtailing a ship’s ability to manoeuvre. It is likely that an initiated operation has to be continued in deteriorating sea conditions and deteriorating visibility. Great concentration and stress cause tiredness, which might result in increased likelihood of a human error. The consequences of a collision might be: traumas, financial damages and environment pollution. Potential material loss caused by the necessity of making changes in the construction schedule are not an element of the OFW impact. The chance of a vessel sinking is insignificant and therefore the frequency of events resulting in a fatality is minimal. For example, in order to assess the navigational risk for the Horns Rev 3 Offshore Wind Farm it was assumed that the number of events depends on a technology and the executive project e.g. the size of the wind turbines, the number of vessels, foundation type. Generally it is anticipated that the risk of collisions between vessels will be increased in the OFW area and on the construction area access routes. In terms of collisions between two vessels it has been anticipated that the larger number of vessels used during the OFW construction and longer time within the OFW area increase the risk of collisions between vessels during operations in the offshore wind farm area. The increase in the risk is also caused by larger number of journeys between the OFW and harbours.

I studied Polish and English in Poland and Australia not only in terms of the usage of language, but also in terms of the general history and cultural context of a particular language. On a few occasions I took part in national student writing essay competitions, winning awards. At university I received the Dean’s Award for the best Master’s Thesis, which was on the subject of language and communication. I worked as a journalist for two years, writing articles for a Polish magazine. Recently I won a competition (organised by TVP and The Times) for the best screenplay for a drama on Polish public television and a short story competition run by one of the Polish publishing houses. I have published a few short stories and articles in English in two different Australian magazines in Sydney and in an English magazine in London. My current work as an interpreter involves working in Law Courts (Sheriff Court, High Court, Justice of the Peace Court, Court of Session), Police Stations, legal offices and barrister’s chambers as well as in the health sector (hospitals, health centres, dental practices), departments of social work and education.
