"(“Client”, ""You"") as your Qualified Representative, because you are:
- currently unrepresented;
- in the custody of the Department of Homeland Security (""DHS"");
- in immigration procedings; and
- found unable to represent yourself."
A Qualified Representative is a licensed attorney, accredited representative, or a law student/graduate under the supervision of a licensed attorney which, exercising independent professional judgement, provides independent zealous and competent representation to you.
Esperanza will legally represent you in the following:
"a. Immigration Proceedings (Before any final order or Determination is Made). This includes:
- Immigration Court Removal / Deportation Hearings (known as INA 240 Proceedings)
- Immigration Court Bond Hearings (known as Custody Redetermination Proceedings)
- Immigration Court Asylum and Withholding Removal Hearings (known as Asylum / Withholding Only Proceedings)
- Appeals before the Board of Immigration Appeals "
b. Bond Proceedings (including after orders become final)
c. Ud. Motions to Reopen and/or Reconsider (related to a. b. and c.)
d.SCIS Proceedings (related to a. and b.)
Esperanza's Representation of you does not include anyone else other than you or create an attorney-client relationship with any person or entity other than you. Representation is not provided before any Article III Court. If you are released from detention while your immigration proceedings are still pending, Esperanza will continue to represent you as Qualified Representative unless and until your case is complete or you move out of our service area, as described in section 7, below.
a. We are representing you pro bono. This means you will not have to pay us legal fees.
b. USCIS, Court, and Other Fees: You understand that Esperanza’s pro bono representation does NOT include any USCIS or court fees.
a. You have the right to be informed about any important developments in your case.
b. You have the right for your attorney to consult you before any significant decision is made on your behalf. Esperanza will abide by your decisions with respects to the objectives of representation, subject to ethical and legal obligations.
c. Esperanza will keep information regarding your case confidential unless you grant Esperanza permission to reveal confidential information to third parties. As is necessary for representation, certain information about your case may be reviewed by others, such as legal personnel in Esperanza besides the assigned attorney, expert witnesses retained for representation in your case, or by others for funding or accreditation purposes, but these individuals/entities are also required to respect your confidentiality.
a. Esperanza cannot and will not agree to represent a client who has relationships or interests adverse to yours.
b. If an actual conflict arises between you and another client, Esperanza will immediately notify you of the conflict. If a conflict arises, Esperanza may have to withdraw from representation and you will be assigned a different Qualified Representative.
a. You must voluntarily give all information regarding your immigration and criminal history, respond honestly and truthfully to all questions asked, abstain from any criminal or other prohibited conduct that may jeopardize your case, and otherwise reasonably cooperate with Esperanza so we can represent you effectively.
b. You must keep Esperanza informed of all developments, including, but not limited to, all changes of name, address, telephone number, marital status, interactions with law enforcement and other information. Please inform us within five (5) calendar days of any change.
c. You must keep all appointments with Esperanza or call us at least 24 hours in advance to reschedule.
a. Esperanza will take reasonable steps to keep you informed of case progress and respond to your case inquiries.
b. Esperanza will keep a copy of your file for 7 years. Esperanza will provide a copy to you upon request. We will return any papers or goods you have provided us upon completion of the case or termination of representation.
c. If Esperanza reassigns your case to another staff member, Esperanza will inform you of the reassignment.
Esperanza will withdraw from Representation if any of the following happen:
a. Withdrawal is required or permitted by law.
b. Our representation would result in a violation of the Rules of Professional Conduct.
"c. Proceedings reach Final Administrative Order because:
- 30 days from initial entry of order has passed and the time to seek review by BIA expires, or
- The BIA has affirmed a decision."
d. 90 days have passed since you were released from DHS custody and your immigration proceedings have reached an end.
e. You hire other Counsel to represent you in your case, at your own expense, AND the Immigration Court approves Esperanza's withdrawal of representation. Because Esperanza is a Qualified Representative, it is possible that the Immigration Court will not approve your request to change Counsel.
f. If, as stated above, a conflict of interest arises.
g. You move out of our service area (Counties of Los Angeles, Orange, Riverside, Ventura, Santa Barbara, San Bernardino, Kern, San Luis Obispo). However, if you move out of our service area, another Qualified Representative in your area will represent you instead of Esperanza.
a. No Guarantee: Esperanza has made no promise or guarantee regarding the outcome of your legal matter. Immigration legal matters can be costly, very frustrating, and lengthy.
b. Retention of Intellectual Property: All intellectual property and other know-how developed during our representation, including our experience in the matter, whether or not preserved in electronic or written form, may be retained by Esperanza and used in connection with commitments on behalf of other clients, provided that we do not disclose confidential information about you.
c. Language: The whole text of this Agreement has been written in English. I have been explained the terms of this agreement in a language that I understand before signing. If I have been provided a copy in my native language, for legal purposes, the text in English is to be given priority of interpretation.
d. Entire Agreement: By signing, you acknowledge you have read this agreement in its entirety, or have been explained this agreement in a language you understand, and have agreed to it, and you understand it.

Esperanza Immigrant Rights Project (“Esperanza”) ha sido contratada para representarlo a usted,
(“Cliente”, “usted”) como su representante legal y calificado, porque usted está:
No está representado legalmente en este momento;
Está en la custodia de el Departamento De Homeland Security (“DHS”);
Está en un proceso migratorio; y
No puede representarse a usted mismo.
Un Representante Calificado es un abogado licenciado, representante acreditado, o estudiante/graduado de derecho bajo la supervisión de un abogado licenciado el cual, ejerciendo su opinión profesional e independiente, le provee a usted una representación independiente, entusiasta, y competente.
1. Clases de Servicios
Esperanza lo va a representar legalmente en lo siguiente:
Diligencias Migratorias (Antes de que se pronuncie una orden final o se haya tomado una determinación). Esto incluye:
Audiencias de expatriación/ deportación en los juzgados migratorios (conocido como diligencia INS 240)
Audiencias de fianza en los juzgados migratorios (conocido como diligencia de re-determinación de custodia)
Audiencias de Pausa de Expatriación y de Asilo (conocido como diligencias solamente de Asilo/ Pausas)
Apelaciones ante la Junta de Apelaciones Migratorias
Diligencias de Fianza (aun después que se pronuncien las órdenes finales)
Diligencias de USCIS (relacionadas con a. y b.)
Pedimentos para reabrir y/o reconsiderar la causa (relacionadas con a. b. y c.)
La Representación de Esperanza hacia usted no incluye a nadie más que usted o alguna relación de licenciado-cliente con cualquier otra persona o entidad que no sea usted. Esta representación no es suministrada sin antes no ejercer el Artículo III Tribunal. Si sale en libertad después de estar en reclusión mientras su diligencia migratoria todavía está pendiente, Esperanza continuará representandolo como su Representante Calificado al menos y/o hasta que su causa termine o usted se mude de nuestra área de servicio, como esta descrito en la sección 7, al pie de este documento.
2. Representación Pro Bono
Lo estamos representando de manera pro bono. Esto significa que no tendrá que pagarnos honorarios .
Cargos de USCIS, Tribunal, y otros: Usted debe entender que la representación de pro bono de Esperanza NO incluye cargos judiciales y de USCIS.
3. Derechos del Cliente.
Tiene derecho a ser informado sobre cualquier acontecimiento en su causa.
Tiene el derecho a que su abogado le consulte antes de tomar cualquier decisión importante por usted. Esperanza apoyara sus decisiones según los objetivos de la representación, sujetos a obligaciones legales y éticas.
Esperanza mantendrá confidencial la información sobre su causa a menos que usted le otorgue a Esperanza el permiso para revelar información confidencial a partes terceras. Como es costumbre en la representación legal, cierta información sobre su causa puede ser revisada por otros, como los empleados de Esperanza, o por otros por motivos de financiación o propósitos de acreditación, pero a estas personas/ entidades también se les requiere respetar su confidencialidad.
4. Conflicto de Intereses.
Esperanza no puede y no estará de acuerdo con representar a un cliente que tiene relaciones o intereses en contra de usted.
En caso de que aparezca un conflicto entre usted y otro cliente, Esperanza le notificará inmediatamente de dicho conflicto. Si surge un conflicto, Esperanza tendrá que retirarse como su representante legal y se le asignará otro Representante Calificado.
5. Los Deberes y Responsabilidades del Cliente:
Usted debe dar toda información sobre sus antecedentes penales y migratorios voluntariamente, responder toda pregunta con honestidad y sinceridad, abstenerse de cualquier conducta que esté prohibida o conducta criminal que pueda poner en riesgo su causa, y seguir cooperando regularmente con Esperanza para que lo podamos representar con eficacia.
Usted debe de mantenernos informados de todo acontecimiento en su vida, incluyendo pero no limitándose a, cambios de nombre, dirección, número de teléfono, estado civil, roses con la agencia del orden público y otra información. Por favor informarnos de cualquier cambio dentro de los siguientes (5) días hábiles de haberse hecho dicho cambio.
Usted debe mantener todas las citas con Esperanza o llamarnos al menos 24 horas antes para reprogramar la cita.
6. Responsabilidades Adicionales de Esperanza para el Cliente.
Esperanza tomará los pasos adecuados para mantenerlo informado del progreso de su causa y también responder a dicha causa.
Esperanza mantendrá una copia de su archivo por 7 años. Si solicita una copia de su archivo, Esperanza le suministrará una. Le regresaremos cualquier documento o artículo que usted nos haya dado al finalizar la causa, o al terminar su representación legal.
Si Esperanza le asigna este caso a otro empleado, Esperanza le informará de dicha asignación.
7. Motivos de Esperanza para Terminar su Representación Legal.
Esperanza terminara su Representación Legal si alguna de las siguientes llega a ocurrir:
Si es requerido terminar su representación o es permisible por ley.
Si nuestra representación viola las Normas de Conducta Profesional.
Si las diligencias llegan a una orden final administrativa por consecuencia:
Que se haya vencido el plazo de 30 días de la solicitud inicial de buscar revisión de la causa por el BIA, o
El BIA ha ratificado su decisión.
Han pasado 90 días desde el momento en que salió de la custodia del DHS y sus diligencias migratorias han llegado a su fin.
Usted contrata otro licenciado para que lo represente en su causa, por sus propios medios económicos, Y el tribunal migratorio aprueba el retiro de la representación de Esperanza. Es posible que el tribunal migratorio no apruebe su solicitud de cambio de licenciado, porque Esperanza es un Representante Calificado.
Si, como se ha mencionado previamente, surge un conflicto de intereses.
Si se muda fuera de nuestra área de servicio (Condado de Los Angeles, Orange, Riverside, Ventura, Santa Barbara, San Bernardino, Kern, San Luis Obispo). Sin embargo, si se muda fuera de nuestra área de servicio, otro Representante Calificado en su área lo representara en vez de Esperanza.
8. Términos Adicionales.
Sin Garantía: Esperanza no da promesas o garantías sobre el resultado de su causa. Los asuntos migratorios pueden resultar largos, costosos, y frustrantes.
Retención de Propiedad Intelectual: Toda propiedad intelectual y otros conocimientos elaborados durante su representación, incluyendo nuestra experiencia en el asunto, ya sea conservado en forma electrónica o en forma escrita, puede ser retenida por Esperanza y usada en otros compromisos de parte de otros clientes, siempre y cuando no revelemos ninguna información confidencial sobre usted.
Lenguaje: Todo el texto de este acuerdo ha sido escrito en inglés. Se me ha explicado los términos de este acuerdo en un lenguaje que yo entiendo antes de firmar. Si se me ha dado una copia en mi lenguaje natal, por propósitos judiciales, se le dará prioridad al texto que está en inglés.

Por medio del presente hago constar que el 10/agosto/2014 como a eso de las 20:00 horas de ese día, el señor Reinaldo Israel Ramírez Hernández, de 40 años de edad, soltero de profesión motorista, residente en Cantón Chorro Arriba, Municipio de Izalco, Departamento de Sonsonate, de El Salvador, quien se identificó con su Documento Único de identidad número 01011141-3, en momentos que nos encontrábamos patrullando el sector del Cantón Chorro Arriba, se acercó y nos informó que su sobrina de nombre Jenniffer Izamar Teshe Ramírez, de 18 años de edad, estaba siendo agredida físicamente por su compañero de vida, por lo que nos dirigimos juntamente con el señor Reinaldo para el lugar donde vivía su sobrina; pero en lo que nos desplazábamos, encontramos a un sujeto quien fue señalado y reconocido por el informante como la persona que estaba agrediendo a su sobrina minutos antes, se le realizó la requisa personal (registro o cacheo) y fue llevando a la sede policial, fue identificado como Néstor Alexis Ramírez Sales, de 19 años de edad, soltero, sin oficio alguno, hijo de la señora María Luisa Sales Chilulo y del señor Carlos Raúl Ramírez, residente en Cantón Chorro Arriba, Caserío Los Hernández, casa sin número, Municipio de Izalco, Departamento de Sonsonate, este fue identificado con su Documento Único de Identidad número 05110915-8. Fue consultado a la base de datos policiales, encontrándole antecedes policiales, debido a que el señor Néstor Alexis Ramírez Sales, está perfilado como miembro activo de la pandilla 18 sureños, con el grado de "palabrero" (lider) dentro de esa estructura terrorista, y es conocido con el alias "liro quimer", dicha agrupación criminal se dedica al tráfico de droga, trata de personas, homicidios, secuestros, extorsión entre otros. Posteriormente fuimos al lugar donde reside la señorita Jenniffer, identificándose como Jenniffer Izamar. Teshe Ramírez, de 18 años de edad, ama de casa, soltera, hija de la señora Flor Aracely Ramírez Hernández y del señor Andrés Esaú Teshe Hernández, residente en Cantón Chorro Arriba, casa sin número, Caserío Los Hernández, Municipio de Izalco, Departamento de Sonsonate de El Salvador, quien se identificó con su Documento Único de Identidad No. 05234529-4. Al preguntarle si había tenía algún problema nos manifestó que su compañero de vida de nombre Néstor Alexis Ramírez Sales, con quien tiene un hijo en común, minutos antes le estaba amenazando y agrediendo físicamente, pero que este ya se había retirado del lugar, se le manifestó que a dicha persona se tenía retenido en la sede policial, necesitando que ella se mostrara ofendida por las amenazas, violencia física y psicológica del cual ella es víctima por parte del agresor; pero dijo no querer acusarlo ni denunciarlo; porque tiene miedo que la asesine a ella y a sus cuatro hermanos menores de edad, (Heidi Damaris, Alexander Esaú, Jordi Aldair y Dayana Valeria apellidos Teshe Ramírez) ya que siempre le amenaza con atentar contra la integridad física de ella y la de sus hermanos, nos retiramos, sin embargo debido a lo expresado por la víctima se mantuvo realizando patrulles en diferentes horas por varios días en dicho sector y así evitar que el señor Néstor Ramírez (agresor), cometiera algún crimen contra la joven y sus familiares.
Además se hace del conocimientos que el señor Néstor Alexis Ramírez Sales, actualmente posee 2 órdenes de captura vigentes, la primera por el delito Agrupaciones ilícitas del año 2016 y la segunda por los delitos de Posesión, Conspiración en caso de Homicidio y Organizaciones Terrorista del año 2017. Por lo que es prófugo de la justicia salvadoreña, desconociendo el paradero del mismo hasta esta fecha.
Informe que hago para los fines legales que las autoridades de la Corte de los Ángeles de Estados Unidos de Norteamérica estimen conveniente.

With this letter I attest that in August 10th, 2014 around 20:00 hours of that day, Mr. Reinaldo Israel Ramirez Hernandez, of 40 years of age, single, with an occupation as a driver, who resides in Canton Chorro Arriba, Municipality of Izalco, Department of Sonsonate, El Salvador, who identified himself with his identification number 01011141-3 at time that we were patrolling the area of Canton Chorro Arriba, approached us and reported that his niece with the name of Jenniffer Izamar Teshe Ramirez, of 18 years of age, was being physically assaulted by his partner. So along with Mr. Reinaldo we headed to his niece’s place of residence; but while we were heading there, we found a person who was identified and recognized by the informant as the person who was assaulting his niece moments earlier, he was patted down (search or seizure) and was taken to the police station. He was identified with the name of Nestor Alexis Ramirez Sales, of 19 years of age, single, unemployed, he is the son of Maria Luisa Sales Chilulo and Carlos Raul Ramirez, resident of Canton Chorro Arriba, Caserio Los Hernandez, house without a number, Municipality of Izalco, Department of Sonsonate, and he was identified with his Identification number 05110915-8. The police database was used in the case, and it found a criminal record. Mr. Nestor Alexis Ramirez Sales is profiled as an active member of 18 Surenos gang, with a rank of “palabrero” (leader) within that terrorist organization, and he is known with the nickname of “liro quimer”. This criminal group focuses on drug trafficking, human trafficking, homicides, kipnappings, and extortion among many other things. Subsequently we went to the place of residence of Miss Jenniffer, who identifies as Jenniffer Izamar Teshe Ramirez, of 18 years of age, homemaker, single, she is the daughter of Flor Aracely Ramirez Hernandez and Andres Esau Teshe Hernandez, resident of Canton Chorro Arriba, house without a number, Caserio Los Hernandez, Municipality of Izalco, Department of Sonsonate of El Salvador, and she was identified with her identification number 05234529-4. Upon asking if she had a problem, she informed us that her partner with the name of Nestor Alexis Ramirez Sales, who she has a child in common with, was threatening her and physically assaulting her, but he had already left the scene. She was informed that this person was taken to the police station, it was necessary that she felt assaulted by the threats, physical and mental violence which she was a victim of; but she expressed no intent of pressing charges because she is afraid that he is going to kill her, and her four small siblings, (Heidi Damaris, Alexander Esau, Jordi Aldair, and Dayana Valeria with Teshe Ramirez as the last names) since he always threatens her physical well-being and that of her siblings. We left the scene, however due to the victim’s account patrol routes were performed at different hours for many days in the area in order to prevent Mr. Nestor Ramirez (aggressor), from committing another offense against the victim and her family.
Furthermore it is notified that Mr. Nestor Alexis Ramirez Sales has two current arrest warrants, the first one for Criminal Conspiracy in 2016, and the second one for the crimes of Possession, Conspire to commit homicide and Organize Terrorist Groups in 2017. Therefore he is a fugitive from salvadorian justice, and his whereabouts are unknown as of this date.
I write this report for the legal purposes that the Los Angeles Superior Court of the United States of America deem appropriate.
