XX agrees to provide professional services subject to the following terms and conditions:
AUTHORIZATION: These Terms and Conditions shall become effective and binding upon the Client upon acceptance, which shall be evidenced by the Client's advice to commence the Services (as herein defined).
COMMITMENT: Upon acceptance, the Firm shall be engaged solely by and for the benefit of the Client to perform certain professional services agreed to and specifically set forth in this Agreement (the "Services"). We undertake all assignments for the Client with a commitment of our resources and energies. CONFIDENTIALITY: All confidential information developed by the Client and made necessarily available to the Firm ("Confidential Information") to perform the Services shall be retained in confidence by the Firm except for: 1) public information; 2) information previously known; 3) information developed independently; and 4) information disclosed by a third party or as required by law. The Firm assumes no liability for the subsequent use or disclosure of Confidential Information made available either to the Firm or others by third party sources (public or non-public) unless due solely to the fault of the Firm.

Petitioner, XX, Administrator of the Estate of YY ("Petitioner"),
alleges as follows:
BACKGROUND INFORMATION
1. This Petition seeks the recovery of YY's ("Decedent")
personal property, to wit, proceeds from the sale of
Decedent's property in the amount of approximately
$315,000, less reasonable costs of the sale. Said funds were
wrongfully taken from Decedent as a result of fraud, breach
of contract and conversion perpetrated on Decedent by
Respondents, and each of them. The funds taken were an asset of the Estate of YY ("Estate").
2. Decedent, at all times relevant hereto a resident of Argentina, died on December 10, 2008, leaving an estate in
Los Angeles County, California.
3. Petitioner, a resident of California, was appointed
Administrator of Decedent's estate and Letters of Special
Administration were issued on December 21, 2009, and are
at present in full effect.
4. The true names and capacities, whether individual, corporate, associate or otherwise of respondents named herein as Does 1 through 20, inclusive, are presently unknown to Petitioners, who therefore sue said respondents by such fictitious names. When the true names and capacities of such respondents are ascertained, Petitioners will ask leave to amend this complaint accordingly. Petitioners are informed and believe and based thereon allege that each of the respondents designated herein as a "Doe" is legally responsible either negligently, intentionally or tortiously, for the events and happenings herein referred to and negligently, intentionally or tortiously caused injuries and damages proximately thereby to Petitioner.

Fundamentos de Derecho. Violación a las normas ambientales y constitucionales.
Que las Naciones de todo el mundo, aproximadamente desde hace 20 años, vienen discutiendo y reglamentando las acciones de los hombres y las empresas que causan un impacto al medio ambiente, por lo que la mayoría de los países han adoptado una legislación para cuidar al medio ambiente. Que los estudiosos de la materia manifiestan que los causantes de la mayor contaminación en el planeta tierra son las empresas mineras y petroleras. Que nuestro país, siendo varios años signatario, por haber sido ratificado por el Congreso Nacional, de varios Convenios. Internacionales, tales como: la Declaración de Río de Janeiro, La Agenda 21, La Declaración sobre Bosques, Convención sobre la Diversidad Biológica, Convenio Marco sobre Cambio Climático, todos aplicables por lo expuesto, los mismos que reglamentan y regulan todas las acciones u omisiones de las personas naturales o jurídicas que ejecuten actos que desestabilicen al medio ambiente. Que en virtud de ello, van a analizar las violaciones en el presente caso por parte de la precitada compañía petrolera; pero que antes es menester hacer la siguiente aclaración; que los daños ambientales causados por cualquier persona natural o jurídica antes de 1998, no constaban en nuestra Constitución Política, sino muy vaga y ambiguamente en la Ley de Hidrocarburos y de Minería. Que es a partir de la Asamblea Nacional de 1998, que “reformó” la Constitución Política del Estado que se incorpora normas jurídicas que reglamentan y sancionan los daños ambientales, como podemos encontrar en la Sección Segunda del medio ambiente, a partir del Art. 86 al 91 inclusive. Que de igual manera se incorporan como derechos colectivos e individuales, en los siguientes artículos 3, 23, 42, 80, 84 97, 229, 233, 240, 243, 247, 248, 251, 267, de la Constitución. Que posteriormente, el Congreso Nacional, discute, aprueba y sanciona la Ley de Gestión Ambiental, publicada en el R.O. No. 245 del 30 de julio de 1999.

For about 20 years, nations all over the world have discussed and regulated individual and corporate actions that have an impact on the environment. Consequently, most countries have enacted legislation to protect the environment. Authoritative opinion on the matter asserts that mining and oil companies account for the largest portion of environmental pollution on the planet. For a number of years, our country has signed and ratified several International Treaties, namely: the Rio de Janeiro Declaration, the Agenda 21, the Declaration on Forests, the Convention on Biological Diversity, the Framework Convention on Climate Change, all of which apply to the situation hereunder and regulate the conduct of natural and legal persons that perform any activity that, by act or omission, might affect the environment. Prior to analyzing YYY’s infractions to these regulations, it is necessary to make it clear that, before 1998, our Constitution did not provide for the environmental harm caused by natural or legal persons; these were vaguely and imprecisely dealt with in the Hydrocarbons Act and the Mining Act. By virtue of the amendment by the National Assembly in 1998, the Constitution included a regulatory scheme in regard to environmental damage, which can be found in sections 86 to 91. Environmental protection was likewise included as both individual and class rights in Sections 3, 23, 42, 80, 84 97, 229, 233, 240, 243, 247, 248, 251, and 267 of the Constitution. Subsequently, Congress discussed, passed and enacted the Environmental Management Act, published in the Official Gazette No. 245, dated July 30, 1999.
