Critical parts of the judgments were directed at how the fruits of the marital partnership (the matrimonial acquest) were to be ascertained, in relation to which they differed slightly.
Secondly, the course of this litigation has to my mind been complicated by the fluctuating stance taken on the part of the respondent, Mrs Miller, in relation to what has been described as the matrimonial acquest, the increase in value of the parties' assets during the marriage.
First, that the starting point of sharing family assets equally can be successfully challenged if the wealth was acquired outside the “matrimonial acquest”, that is acquired before or after the relationship or through inheritance.
