I think that's the best solution in this case. More precisely, 'indirect perpetration via obliquation of knowledge' or something to that effect. I think it's most important to have the German term along with a helpful description (instead of trying to 'get even' with it).

"Indirect perpetration'" is precisely what this is. This is probably the most accurate term. In this instance, it is more suitable than "respondeat superior", which implies that it is the employer who caused the employer to perpetrate the act, whereas in this instance the opposite is the case (i.e. the employee caused the employer to perpetrate the act).

In German doctrine, the figure of «Tatherrschaft» (dominion of the act) has been developed by my famous Munich colleague Claus Roxin and has been, to some extent, accepted by German jurisprudence. Irrtumsherrschaft setzt voraus, dass der Hintermann in der konkreten Situation mehr weiß als der unmittelbar Handelnde. As far as I know, the US doesn't have the concept. My starting suggestion is Irrtumsherrschaft (superiority in the chain of culpability).

Respondeat superior is [edited: a similar concept] used in employee-employer cases.
