Mentre l’essiccazione al sole nasce da una tradizione secolare, era infatti l’unico modo per poter consumare pomodoro anche d’inverno, il semi dried (semi essiccato nei forni) viene introdotto nella produzione Fiordelisi come un’evoluzione nella ricerca sui metodi di trasformazione del pomodoro. Sin da subito il nostro pomodoro semi dried ha rappresentato l’alternativa ai grandi produttori francesi, i primi ad effettuare questo tipo di produzione, e si è distinto per le caratteristiche organolettiche. Le varietà di pomodoro scelte sono quelle tonde a grappolo. Da questi vengono ottenuti, tramite selezione manuale ,calibratura meccanica e taglio, gli spicchi che poi vengono distribuiti nei grandi forni con nastri in continuo. Qui il pomodoro viene lasciato ad appassire per molte ore ad una temperatura non troppo alta, permettendo agli spicchi di mantenere polpa soda e colore rosso brillante e conservando le caratteristiche del pomodoro fresco. Una marinatura fatta con purea di aglio fresco e origano, dona ai pomodori semi dried Fiordelisi un sapore ricco e dolce.
NOTA TECNICA: La capacità produttiva di Fiordelisi è circa di 700 ton ma con una favorevole propensione all'incremento.

Ingredienti per 4 persone:
280g Pomodori semi dried Fiordelisi
200g Mozzarella
Olio extra vergine d'oliva
Basilico fresco
Preparazione
Sgocciolare i pomodori dall'olio di conservazione. Tagliare la mozzarella a fettine e disporla su un piatto da portata. Distribuire i pomodori semi dried sulla mozzarella, cospargere con un filo d'olio extra vergine di oliva e guarnire con qualche foglia di basilico fresco.
IL PERINOS
Dopo tre anni di ricerca Fiordelisi ha introdotto sul mercato il Perinos, un mini pomodoro grande solo 2cm, dalla caratteristica forma a pera e dalle importanti caratteristiche organolettiche, di colore rosso intenso, dalla polpa soda e il gusto dolce.
Il Perinos è povero di calorie e ricco di zuccheri semplici, sali minerali ed antiossidanti come il licopene e la vitamina C e grazie alle sue caratteristiche fisiche può essere pelato come le varietà di pomodoro più grandi. Grazie a queste sue caratteristiche si presta non solo all'essiccazione al sole, ma anche alla semi essiccazione divenendo l'unico pomodoro semi dried intero e senza la pelle. Una vera novità che diventa spunto per tante sfiziose ricette.

INVOLTINI DI ZUCCHINE RIPIENI DI FORMAGGIO E PERINOS SEMI DRIED
Ingredienti per 4 persone:
200g di zucchine secche grigliate Fiordisole
300g di formaggio fresco spalmabile
150g di perinos semi dried
Olio extra vergine di oliva q.b.
Preparazione
Reidratare le zucchine tenendole in acqua tiepida per circa 15 minuti, facendogli riacquistare una consistenza morbida, dopodiché scolarle e strizzarle per eliminare l'acqua in eccesso.
In un recipiente aggiungere al formaggio fresco il Perinos dopo averlo sgocciolato dall'olio e lavorarli insieme per amalgamarli.
Stendere le fette di zucchine reidratate su un piano da lavoro e spalmarle con la crema di formaggio fresco e Perinos e arrotolare le fette così condite per formare gli involtini.
Disporre gli involtini sul piatto, guarnire con uno o due mini pomodori Perinos per ogni involtino e condire con un filo di olio extra vergine di oliva.
TUBETTI CON RICOTTA E PERINOS SEMI DRIED
Ingredienti per 4 persone:
350g di Pasta tipo tubetti
200g di Ricotta fresca di pecora
150 g di Perinos smei dried
Sale
Preparazione:
In una terrina mescolare la ricotta con il Perinos ben sgocciolato dall'olio di conservazione e un pizzico di sale, fino ad ottenere una crema ben omogenea. Cuocere la pasta al dente e scolarla lasciandola ben “umida”. In una casseruola aggiungere la ricotta e Perinos preparata in precedenza ai tubetti e mescolare a fuoco dolce, amalgamando per bene la salsa alla pasta.
Può essere servito sia caldo o che freddo.

While sun-drying comes from a centuries-old tradition, making it possible for the tomato to be consumed during winter, the semi dried tomato (semi dried in the oven) has been introduced into the production of Fiordelisi as an evolution in the research of methods of tomato processing. Right from the beginning our semi dried tomato has become the alternative for the big French producers, being the first to carry out this type of production, and moreover being distinguished for its organoleptic characteristics. The tomato varieties chosen for this production are those round clustered tomatoes. From these tomatoes, with the help of manual selection, mechanical sizing and cutting, we obtain the segments which are then distributed in large ovens with continuous conveyer belts. Here, the tomato is being left to dry for several hours at a moderate temperature, allowing the segments to keep the flesh firm and the color bright red, preserving the characteristics of fresh tomatoes. A marinade made with fresh garlic and oregano puree, gives the semi dried Fiordelisi tomatoes a rich flavor and sweetness.
TECHNICAL NOTE: The production capacity of Fiordelisi is about 700 tons with a favorable tendency for the increase.

Preparation:
Drain the tomatoes from the conservation oil. Cut the mozzarella into slices and arrange on a serving dish. Distribute semi dried tomatoes on the mozzarella, sprinkle with a bit of extra virgin olive oil and garnish with a few leaves of fresh basil.
THE PERINOS
After three years of research Fiordelisi has introduced the Perinos, a mini tomato being just 2cm in size, with the pear shape, having important organoleptic characteristics, an intense red color and the firm and sweet-tasting flesh. The Perinos are low in calories and rich in simple sugars, minerals and antioxidants such as lycopene and vitamin C. Owing to its physical characteristics it can be peeled just like larger varieties of tomatoes. Thanks to these characteristics it is good not only for sun drying, but also for semi drying, making it the only entirely semi dried tomato and without the skin. A real novelty that became a starting point for many delicious recipes.

ZUCCHINI ROLLS STUFFED WITH CHEESE AND SEMI DRIED PERINOS
Ingredients for 4 people:
200g grilled zucchini dry Fiordisole
300g of fresh cheese
150g of dried seeds perinos
Extra virgin olive q.b.
Preparation:
Rehydrate the zucchini keeping them in warm water for about 15 minutes, making them regain a soft consistency, then drain and squeeze to remove excess water. In a bowl, add the the Perinos with fresh cheese after having them drained from the oil and mix them together. Spread the rehydrated slices of zucchini on a work surface and spread the cheese cream and fresh Perinos and roll up the well seasoned slices to form the rolls. Arrange the rolls on a plate, garnish with one or two mini Perinos tomatoes for each roll and serve with a drizzle of extra virgin olive oil.
TUBES WITH RICOTTA CHEESE AND SEMI DRIED PERINOS
Ingredients for 4 people:
350g Pasta of tubes shape
200g fresh sheep ricotta
150 g of semi dried Perinos

Preparation:
Mix the ricotta cheese with a pinch of salt and the well drained Perinos out of the conservation oil in a bowl until you get a smooth cream. Cook the pasta al dente and drain it, leaving it a bit "wet". In a saucepan, add the ricotta and Perinos, prepared previously in tubes and stir on low heat, making it into a proper pasta sauce. It can be served either hot or cold.

Source text - Ukrainian Поступово в міжнародному судноплавстві склались дві форми організації перевезень — лінійна (регулярна) і трампова (нерегулярна).
Лінійне судноплавство - форма транспортних послуг, що забезпечує регулярні перевезення між установленими портами генеральних вантажів за заздалегідь оголошеним розкладом. Сполучення регулярними лініями підтримується одним або кількома судноплавними компаніями.
Лінійні перевезення вважаються більш прогресивною формою морських перевезень, бо вони мають такі переваги:
- регулярність здійснення з дотриманням термінів, передбачених відповідним розкладом;
- відносно стабільні і завжди відомі наперед тарифи;
- використання для перевезень спеціалізованого тоннажу;
- доступність завдяки використанню широкої мережі агентів .
Проте саме ці переваги призводять до того, що тарифи на лінійні перевезення є значно більшими порівняно з траповими.
На відміну від лінійних перевезень трапове судноплавство характеризується тим, що робота суден не пов'язана з постійними районами плавання чи портами, відсутністю обмежень за видами вантажів, а ціна перевезення встановлюється за домовленістю сторін.
Трамповими (англ, "tramp" - бурлака) називаються судна, що здійснюють нерегулярні рейси, без чіткого розкладу, і скеровуються судновласниками туди, де з боку фрахтувальників є попит на тоннаж. Трампові судна перевозять в основному масові вантажі: ліс, руду, вугілля, зерно, нафтопродукти й інші вантажі, перевезені навалом або наливом. Більшість трампових суден універсальні і можуть за необхідності перевозити генеральні вантажі - упаковані й неупаковані товарно-штучні вантажі (устаткування, хімікати, апаратуру, металовироби, автомобілі, трактори, вагони, сільськогосподарську техніку). Таким чином, на цих суднах під вантаж може бути надане все судно або його частина, або певні вантажні приміщення.
Трампові перевезення, юридичною формою яких виступає чартер, регулюються внутрішнім законодавством держави. Договір морського перевезення в трамповому судноплавстві має форму чартеру. Частіше всього такий договір укладається за допомогою посередника чи фрахтового брокера і містить низку обов'язкових умов стосовно судна, вантажу, фрахту, порядку оплати вантажно-розвантажувальних (стівідорних) робіт, премій за дорожні завантаження і розвантаження (діспача), демереджа.
Рейсовий чартер. У національному праві багатьох країн рейсовий чартер розуміється як договір морського перевезення вантажу з умовою надання під вантаж усього судна чи його окремих приміщень. За договором фрахтувальник зобов'язується передати цей вантаж судновласнику та сплатити фрахт. Рейсовий чартер фрахтівник укладає від свого імені та робить це сам, або за допомогою посередника — брокера. Рейсовий чартер і договір судновласника з брокером — це два юридично самостійних договори.
Виконання рейсового чартеру здійснюється в чотири етапи:
- рейс судна в місце, обумовлене як узгоджений пункт завантаження вантажу;
- прийом вантажу, включаючи його завантаження й укладання;
- транспортування вантажу в місце, обумовлене як узгоджений пункт розвантаження судна;
- видача вантажу, включаючи операції по розвантаженню судна.
Стандартні форми рейсових чартерів містять 45 і більше пунктів (окрім додаткових пунктів аддендума). Серед них слід відзначити, лише деякі основні положення, які мають найбільше значення.
Вантаж передається перевізникові самим фрахтувальником, або він з цією метою наймає інших осіб — експедитора або експедитора вантажу.
У першому випадку фрахтувальник судна та відправник вантажу співпадають в одній особі, в другому ж — ні. Звичайно вантаж приймається вантажним помічником капітана, під який він видає штурманську розписку. Іноді замість вантажного помічника капітана виступає береговий посередник — вантажний агент.
Відомості про вантаж завжди приводяться в чартері. Як правило, фіксується кількість вантажу, яка має бути пред'явлена та прийнята до перевезення, а також рід і вид вантажів. Якщо в чартері перелічені вантажі декількох видів, це означає, що фрахтувальник залишив за собою право обирати для транспортування вантаж одного чи декількох видів з переліку, вказаного в чартері. Предмет перевезення може бути визначений і найзагальнішим чином — "будь-який законний вантаж". Точна кількість вантажу вказується в чартері досить рідко. Як правило, встановлюються межі, в яких визначається кількість вантажу.
1.2. Поняття та сутність договору перевезення вантажів морським транспортом.
Договір фрахтування судна і договір морського перевезення вантажів визнаються різними правовими інститутами далеко не у всіх країнах. Зокрема, російське морське законодавство не визнає самостійного існування договору фрахтування на рейс, а передбачає лише два види договору морського перевезення вантажу . У сучасному ж українському морському законодавстві визнається наявність двох форм договору морського перевезення вантажу. При цьому встановлюється, що договір морського перевезення вантажу може бути укладений:
1) з умовою надання для перевезення всього судна, частини його або визначених суднових приміщень (чартер);
2) без такої умови.
Крім відмінних рис, форми (види) договору морського перевезення вантажу мають і загальні риси. Наприклад, економічною метою одного й іншого є переміщення вантажу морським шляхом з одного порту в іншій.
З приведеного визначення договору морського перевезення вантажу випливає, що учасниками договору є перевізник або фрахтівник, відправник або фрахтувальник, а також одержувач. При цьому передбачається, що сторонами договору морського перевезення є перевізник або фрахтівник і відправник або фрахтувальник, а одержувач — це третя особа, на користь якої й укладений договір.
Що стосується зовнішньої форми договору морського перевезення вантажу, то він повинний бути укладений у письмовій формі. Письмова форма договору передбачає поряд зі звичайною письмовою формою телеграму, телекс, факс і т.ін . У міжнародних нормативних документах немає прямої вказівки на те, що договір морського перевезення вантажу повинний бути укладений у письмовій формі. Однак аналіз положень Міжнародної конвенції про уніфікацію деяких правил про коносамент 1924 р. і Конвенції ООН про морське перевезення вантажів 1978 р. дозволяє зробити висновок про те, що письмова форма договору морського перевезення вантажу є бажаною, тому що наявність і зміст договору морського перевезення вантажу можуть підтверджуватися саме письмовими доказами. Такими нормами є правила, що закріплюються в пп. З «а» і 3 «Ь» ст. З Конвенції 1924 р., п. З ст. 10 Конвенції 1978 р. А письмова форма, відповідно до правил п. 8 ст. 1 Конвенції 1978 р., «включає, поряд з іншим, телеграму і телекс».
При перевезеннях у закордонному сполученні договір перевезення вантажу оформляється чартером і коносаментом або тільки коносаментом. І власне договором у цьому випадку є тільки чартер, тому що коносамент є одностороннім документом, що складається і підписується перевізником. Він представляє собою один з тих письмових документів, що вказують наявність і зміст договору морського перевезення вантажу.
2.2. Міжнародно-правова регламентація відповідальності сторін під час здійснення морських перевезень вантажу.
Гаазькі правила встановлюють відповідальність перевізника за втрату чи пошкодження вантажів, охоплюючи практично всі варіанти відповідальності морського перевізника перед вантажовласником. Положення про відповідальність носять імперативний характер, будь-який відхід від них не правомірний.
Це ключові положення Гаазьких правил. Вони формулюються у вигляді переліку 17 підстав, що звільняють перевізника від відповідальності. Ні перевізник, ні судновласник не відповідають за втрату чи збитки, які виникли внаслідок або як результат:
1) дій, недбалості чи упущення капітана, члена екіпажу, лоцмана або працівників перевізника в питаннях судноводіння чи управління судном;
2) пожежі, якщо тільки вона не виникла внаслідок дій або провини перевізника;
3) ризиків, небезпек або випадковостей на морі чи в інших суднохідних водах;
4) нездоланної сили;
5) військових дій;
6) дій антигромадських елементів;
7) арешту чи затримання владою, урядом або народом чи накладення судового арешту;
8) карантинних обмежень;
9) дій або упущень відправника чи власника вантажів, його агента чи представника;
10) страйків, локаутів або призупинення чи затримки робіт з якихось причин повністю чи частково;
11) повстань або народних хвилювань;
12) рятування чи спроби порятунку життя чи майна на морі;
13) втрати об'єму або ваги чи будь-якої іншої втрати та пошкодження, що виникли через приховані недоліки, особливу природу вантажу чи властивих вантажу вад;
14) недостатність упаковки;
15) неповноти чи недоліків маркування;
16) прихованих недоліків, які неможливо виявити при огляді;
17) усіх інших причин, які виникли не через дії і не з вини перевізника, а також не з вини агентів або працівників перевізника .
Наведений перелік дозволяє стверджувати, що відповідальність перевізника базується на принципі презумпції вини, яка може бути спростована власне перевізником.
Щодо порядку пред'явлення вимог до перевізника Гаазькими правилами встановлений такий порядок:
- заяву про збитки необхідно оформляти перевізникові чи його агенту в письмовій формі в порту вивантаження до чи під час передачі вантажу особам, яким його необхідно передати за договором перевезення, інакше виникає презумпція здачі вантажу у відповідності з описом у коносаменті;
- якщо збитки не можуть бути розпізнанні відразу, то заява може бути зроблена протягом трьох діб з моменту видачі вантажу;
- термін позовної давності за вимогами до перевізника про збитки — один рік після доставлення вантажу.
Якщо характер і вартість вантажу не були оголошенні відправником до завантаження та не внесені в коносамент, перевізник не відповідає за будь-які втрати чи пошкодження, завданні вантажу, в сумі, що перевищує еквівалент 10 000 франків Пуанкаре за місце чи одиницю. Або ж ЗО франків Пуанкаре за один кілограм ваги брутто втраченого чи зіпсованого вантажу, в залежності від того. яка сума більша.
Загальна сума, яку необхідно компенсувати, вираховується, виходячи з вартості вантажу в тому місці та в той день, де і коли він був чи мав бути вивантажений з судна за договором. Вартість вантажу визначається за ціною на товарній біржі чи, за відсутності такої ціни, — за існуючою ринковою ціною, а якщо немає жодної з цих цін, — виходячи із звичайної вартості вантажів того
ж роду та якості.
Перевізник не відповідає за втрату чи пошкодження, завдані вантажу, або пов'язанні з ними, якщо відправник заздалегідь, завідомо неправдиво вказав у коносаменті його характер чи вартість.
Легкозаймисті, вибухові, небезпечні вантажі, на завантаження яких перевізник, капітан чи агент перевізника, знаючи про їх природу та характер, не погодились би, можуть в будь-який час вивантажені з судна в будь-якому місці, знищені чи знешкодженні перевізником без компенсації. Відправник таких вантажів несе відповідальність за всі збитки та витрати, які прямо чи опосередковано виникли внаслідок або стали результатом їх вивантаження.
У випадку дійсних або припустимих втрат і збитків перевізник та отримувач зобов'язані надавати один одному всі можливості для перевірки вантажу та підрахунку місць. Регресний позов може бути пред'явлено навіть по закінченню триденного терміну, але в строк, встановлений законом суду, який розглядає справу. Однак цей термін має бути не меншим трьох місяців з дня, коли позивач за регресним позовом задовольнив вимогу чи отримав повідомлення про початок судового процесу за позовом вже до нього.
Перевізник несе відповідальність за збитки, що стали наслідком ушкодження чи втрати, а також затримки у виданні вантажу, якщо причини збитків виникли під час перебування вантажу у його віданні, якщо тільки перевізник не доведе, що було вжито всіх заходів для запобігання цим обставинам та їх наслідкам.
Вантаж вважається втраченим, якщо він не був зданий у термін 60 календарних днів після закінчення призначеного терміну здачі.
Перевізник несе відповідальність за пошкодження чи затримку у видачі вантажу, по причині пожежі, якщо особа, яка висуває вимогу, доведе, що це трапилося з вини перевізника, його робітників або агентів.
3.1. Норми національного законодавства України, що визначають поняття договору перевезення вантажу морським транспортом
Щодо України, то під договором морського перевезення вантажу, у відповідності зі ст. 133 КТМ України , варто розуміти договір, по якому «перевізник або фрахтівник зобов'язується перевезти довірений йому відправником вантаж з порту відправлення в порт призначення і видати його уповноваженій для одержання вантажу особі, а відправник або фрахтувальник зобов'язується сплатити за перевезення встановлену плату».
Що стосується зовнішньої форми договору морського перевезення вантажу, то у відповідності зі ст.134 КТМ України він повинний
бути укладений у письмовій формі. Письмова форма договору передбачає поряд зі звичайною письмовою формою телеграму, телекс, факс і т.ін. У міжнародних нормативних документах немає прямої вказівки на те, що договір морського перевезення вантажу повинний бути укладений у письмовій формі. Однак аналіз положень Міжнародної конвенції про уніфікацію деяких правил про коносамент 1924 р. і Конвенції ООН про морське перевезення вантажів 1978 р. дозволяє зробити висновок про те, що письмова форма договору морського перевезення вантажу є бажаною, тому що наявність і зміст договору морського перевезення вантажу можуть підтверджуватися саме письмовими доказами.
Що стосується національного морського законодавства України,
то документами, що підтверджують наявність і зміст договору морського перевезення вантажу, у відповідності зі ст. 134 КТМ України, є:
- рейсовий чартер — якщо договір передбачає умову надання для
перевезення всього судна, його частини або визначених суднових
приміщень;
- коносамент — якщо договір не передбачає умов надання для перевезення всього судна, його частини або визначених суднових приміщень;
- інші письмові докази .
При перевезеннях у закордонному сполученні договір перевезення вантажу оформляється чартером і коносаментом або тільки коносаментом. І власне договором у цьому випадку є тільки чартер, тому що коносамент є одностороннім документом, що складається і підписується перевізником. Він представляє собою один з тих письмових документів, що вказують наявність і зміст договору морського перевезення вантажу.
Чартер — це двосторонній документ, договір морського перевезення вантажу, яким оформляються відносини перевізника і відправника при наданні для перевезення вантажу всього судна або його частини. У ст. 136 КТМ України закріплюється перелік основних реквізитів чартеру. У чартері детально розробляються і узгоджуються сторонами умови перевезення. Крім того, у ньому вказуються характеристики судна, час і місце його подачі і т.д. Чартер підписується фрахтувальником і фрахтівником або їх законними представниками. Мінімальне коло умов, що повинен містити кожен чартер, щоб мати юридичну силу, визначений чинним законодавством. Цими реквізитами є найменування сторін, розмір фрахту, позначення судна, вантажу, місця навантаження, місця призначення або напрямку судна. Зазвичай чартер містить більш 40 пунктів, які докладно регулюють умови перевезення.

Tramps are called vessels engaged in irregular routes, without a clear timetable and are directed by ship owners to the places where there is a demand for tonnage from the charterers. Most tramp vessels are all purpose and can, if necessary, carry general cargo – packed and unpacked inventory piece goods (machinery , chemicals, equipment , hardware , cars , tractors , cars, farm machinery ). Trump transportations, the legal form of which is a charter, are governed by the internal laws of the State. The contract of affreightment in tramp shipping has a charter form. Voyage charter. In domestic law of many countries voyage charter is understood as a contract of maritime carriage of goods under the terms of leasing a part or all of a vessel for cargo load. Under the contract the charterer is obliged to transfer the cargo and the ship owner to pay the freight. The charterer signs a voyage charter on his behalf and makes it on his own, or through an intermediary, videlicet a broker. Voyage charter and the contract between a ship owner and a broker, are two legally separate contracts.
Execution of a voyage charter is done in four stages:
- Voyage of the vessel to the place, defined as a consistent point of cargo loading;
- Receipt of the goods, including its loading and stacking;
- Transportation of cargo to the place defined as the concerted point of the vessel discharging;
- Delivery of the goods, including unloading operations on the ship. Standard forms of the voyage charters contain 45 or more points (excluding extra points in the addendum). Among them we should mention only some key provisions that are most important.
The load is delivered to the carrier by the freighter, or the latter employs others to do this job, such as shipper or forwarding agents.
In the first case, the freighter of the vessel and the consignor coincide in one person, whereas in the second – they do not. Regularly the load is being received by truck mate, for which he gives navigation receipt. Sometimes, a coastal mediator - freight agent is instead of a cargo mate.
Information about goods is always given in the charter. Typically, the amount of cargo that must be presented and accepted for transportation as well as sort and type of cargo is fixed. If the charter lists several types of loads, it means that the freighter has reserved the right to choose, for the transportation, goods of one or more types from the list specified in the charter. The subject of transportation can be determined by the most common way - "any legitimate cargo." The exact quantity of goods in the charter is specified rarely. Normally, the limits are set, within which the amount of cargo is determined.
1.2. The concept and nature of the contract of carriage of goods by sea.
The contract of affreightment and the contract of carriage of goods by sea are recognized by various legal institutions, but not in all countries. In particular, the Russian maritime law does not recognize the independent existence of the voyage charter, and allows only two types of contract of carriage of goods by sea. At present, the Ukrainian maritime law recognizes the existence of two forms of the contract of carriage of goods by sea. Thus it is established that the contract of carriage of goods by sea can be concluded:
1) with the condition of the leasing of all, part or designated areas of the vessel (charter)
2) without such conditions.
In addition to distinctive features, forms (types) of the contract of affreightment have also common features. For example, the economic purpose of the one and the other is the movement of goods by sea from one port to another.
With the hereby stated definition of the contract of carriage of goods by sea, it can be deduced that the parties to the contract are a carrier or charterer, shipper or freighter, and consignee. Hereat it is assumed that the parties to the contract of carriage of goods by sea are the carrier and the charterer or shipper and freighter and the consignee is a third person for whose benefit contract is compiled.
In regards to the external form of the contract of carriage of goods by sea, it must be concluded in writing. The written form of contract foresees, along with the usual form, writing a telegram, telex, fax and etc. The international regulations provide no direct indication that the contract of affreightment must be concluded in writing. However, the analysis of the provisions of the International Convention for the Unification of Certain Rules of lading of 1924 and the UN Convention on maritime cargo of 1978 suggest that the written form of the contract of carriage of goods by sea is desirable because the presence and content of the abovementioned contract can be confirmed by the written evidence. These norms are the rules that are fixed in private law 3 "a" and 3 " b " Art. 3 of the Convention of 1924, cl. 3 Art. 10 of the Convention of 1978. And the written form, in accordance with the rules of § 8. Art. 1 of the Convention of 1978, "includes, inter alia, telegram and telex".
When transporting in foreign connections the contract of affreightment is executed through a charter or a bill of lading or only though a bill of lading. And in fact the contract in this case is only a charter because the bill of lading is a unilateral document drawn up and signed by the carrier. It represents one of those written documents that indicates the presence and content of the contract of carriage of goods by sea.
2.2. International legal regulation of the responsibilities of the parties in the course of maritime transport.
Hague rules establish carrier’s liability for loss or damage of cargo, including nearly all variations of carrier’s liability to ship owner. Legal regulations are mandatory, and any departure from them is not justified.
These are the key provisions of the Hague Rules. They are formulated in the form of a list of 17 grounds that exempt the carrier from liability. Neither the carrier nor the ship owner is responsible for any loss or damage arising from or as a result of:
1) Act, neglect, or default of the master, mariner, pilot, or the servants of the carrier in the navigation or in the management of the ship.
2) Fire, unless caused by the actual fault or privity of the carrier.
3) Perils, dangers and accidents of the sea or other navigable waters.
4) Act of God.
5) Act of war.
6) Act of public enemies.
7) Arrest or restraint or princes, rulers or people, or seizure under legal process.
8) Quarantine restrictions.
9) Act or omission of the shipper or owner of the goods, his agent or representative.
10) Strikes or lockouts or stoppage or restraint of labour from whatever cause, whether partial or general.
11) Riots and civil commotions.
12) Saving or attempting to save life or property at sea.
13) Wastage in bulk or weight or any other loss or damage arising from inherent defect, quality or vice of the goods.
14) Insufficiency of packing.
15) Insufficiency or inadequacy of marks.
16) Latent defects not discoverable by due diligence.
17) Any other cause arising without the actual fault or privity of the carrier, or without the actual fault or neglect of the agents or servants of the carrier, but the burden of proof shall be on the person claiming the benefit of this exception to show that neither the actual fault or privity of the carrier nor the fault or neglect of the agents or servants of the carrier contributed to the loss or damage.
The list suggests that the carrier's liability is based on the principle of presumption of guilt, which can be refuted by the actual carrier.
On the order of presentation of claims to the carrier Hague Rules set the following sequence:
- Unless notice of loss or damage and the general nature of such loss or damage be given in writing to the carrier or his agent at the port of discharge before or at the time of the removal of the goods into the custody of the person entitled to delivery thereof under the contract of carriage, or, if the loss or damage be not apparent, within three days, such removal shall be prima facie evidence of the delivery by the carrier of the goods as described in the bill of lading.
- If the loss or damage is not apparent, the notice must be given within three days of the delivery of the goods.
- The statute of limitations for claims against the carrier for damages is one year after delivery of goods.
Neither the carrier nor the ship shall in any event be or become liable for any loss or damage to or in connexion with goods in an amount exceeding 100 pounds sterling per package or unit, or the equivalent of that sum in other currency unless the nature and value of such goods have been declared by the shipper before shipment and inserted in the bill of lading.
The total amount that must be compensated is calculated based on the value of the goods at the place and on the day, where and when it was or had to be unloaded from the ship according to the contract. The value of goods is determined by the price of the commodity exchange or in the absence of such a price, at current market value, and if not such prices exists, based on the normal value of goods of same kind and quality.
The carrier is not liable for any loss or damage caused to the goods, or related to them, if the sender beforehand falsely indicated in the bill of lading its nature or value.
Goods of an inflammable, explosive or dangerous nature to the shipment whereof the carrier, master or agent of the carrier has not consented with knowledge of their nature and character, may at any time before discharge be landed at any place, or destroyed or rendered innocuous by the carrier without compensation and the shipper of such goods shall be liable for all damage and expenses directly or indirectly arising out of or resulting from such shipment.
In the case of any actual or apprehended loss or damage the carrier and the receiver shall give all reasonable facilities to each other for inspecting and tallying the goods. Recourse may be filed even after the end of the three-day period, but in the time frames established by the law of the court, that is trying the case. However, this period should not be less than three months from the date on which the claimant by recourse satisfied the request or received notice of the start of the trial with lawsuit addressed to him.
The carrier is liable for losses resulting from damage or loss, and delay in the distribution of the goods, if the reasons for the losses occurred during the stay of cargo in his possession, unless the carrier proves that all steps have been taken to prevent these circumstances and their consequences.
The cargo is considered lost if it was not delivered within the period of 60 calendar days after the designated deadline.
The carrier is liable for damage or delay in delivery of goods, due to the fire, if the person that puts in claims proves that it was the fault of the shipper, he’s employees or agents.
